Welcome to PestFree ("Company," "we," "us," or "our"). By accessing or using our website at pestfree.life and any services offered through it (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Services Overview

PestFree provides pest control information, consultation, and connects customers with qualified pest control service providers. Our Services include, but are not limited to, pest identification guidance, service coordination, and customer support.

2. Service Referrals

You acknowledge and agree that PestFree may, at its sole discretion, refer or direct your pest control service request to third-party pest control providers, partner companies, or affiliated businesses. Referrals may be made for any reason, including but not limited to:

The specific pest type falls outside our current service offerings
The infestation requires specialized treatment that a partner provider is better equipped to handle
Your geographic location is better served by a local or regional partner
Scheduling availability or capacity constraints
The scope or complexity of the service request
Any other reason we determine in our sole discretion

When a referral is made, your contact information and relevant service details may be shared with the referred provider so they can assist you. We are not responsible for the services, pricing, quality, or conduct of any third-party provider to whom you are referred. Any agreement you enter into with a referred provider is solely between you and that provider.

PestFree may receive compensation, referral fees, or other consideration from third-party providers for referrals made through our Services. This does not affect the cost of services to you from the referred provider.

3. No Guarantee of Service

While we strive to connect you with quality pest control services, PestFree does not guarantee that services will be available in your area, for your specific pest issue, or within any particular timeframe. We reserve the right to decline any service request for any reason.

4. Customer Responsibilities

When using our Services, you agree to:

Provide accurate and complete information about your pest control needs
Provide a valid phone number and/or email address for service coordination
Be available at the agreed-upon time for scheduled service appointments
Disclose any relevant information about your property, including known hazards, chemical sensitivities, or access restrictions
Comply with all pre- and post-treatment instructions provided by the service technician

5. Pricing and Payment

Service pricing varies based on the type of pest, severity of infestation, property size, and other factors. All pricing is provided on a case-by-case basis. Any quotes provided are estimates and may be subject to change upon inspection. Final pricing will be confirmed before treatment begins. Payment terms will be established at the time of service.

6. Satisfaction Guarantee

Our satisfaction guarantee, where offered, applies to services performed directly by PestFree technicians. If pests covered under your treatment plan return between scheduled visits, we will re-treat at no additional cost. This guarantee does not apply to services performed by third-party referred providers, who may have their own warranties and guarantees.

7. Limitation of Liability

To the fullest extent permitted by law, PestFree and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our Services, including but not limited to:

Property damage beyond the scope of normal pest control treatment
Services performed by third-party referred providers
Delays or interruptions in service
Any loss or damage resulting from pest activity before, during, or after treatment

Our total aggregate liability for any claims arising from or related to these Terms or our Services shall not exceed the total amount you paid to PestFree in the twelve (12) months preceding the claim.

8. Communications Consent

By providing your phone number or contacting us, you consent to receive calls, text messages, and other communications from PestFree and any referred service providers regarding your service request. Message and data rates may apply. You may opt out of marketing communications at any time.

9. Intellectual Property

All content on this website, including text, graphics, logos, and design elements, is the property of PestFree and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

10. Privacy

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information. By using our Services, you consent to our data practices as described in the Privacy Policy.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of our Services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our Services shall be resolved in the courts located in Travis County, Texas.
